PUBLIC OFFERLLP "IKTASHIF QAZAQSTAN" — CURRENT VERSION
This Public Offer (hereinafter, the "Offer") is an official proposal by LLP "Iktashif Qazaqstan" (hereinafter, the "Company," "We") to enter into an agreement on the terms set forth below with any capable person (hereinafter, the "Client," "You").
Any actions by the Client directed toward using the Company's services, including but not limited to: contacting via Instagram, WhatsApp, the website, phone, email, providing data for booking, or making payment, constitute full and unconditional acceptance of this Offer regardless of whether the Client has read its contents.
1. GENERAL PROVISIONS1.1. This Offer regulates the relationship between the Company and the Client within the framework of providing tourist, transportation, and excursion services on the territory of the Republic of Kazakhstan.
1.2. The Company is an inbound tour operator providing services to foreign tourists.
1.3. The Offer is valid without a paper signature and is legally binding on all Clients.
1.4. The Client understands and agrees that the Company may engage partner organizations, including but not limited to: hotels, resorts, transportation services, guides, and travel agencies.
2. SCOPE OF THE OFFER2.1. The Company provides the Client with a range of tourist services, including but not limited to:
- Booking hotels, apartments, villas, resorts, cottages;
- Booking transportation with drivers (sedans, SUVs, minivans, buses);
- Airport transfers to and from;
- Individual and group tours;
- Guide services (Russian, English, Arabic);
- Personalized itinerary planning;
- VIP, luxury services, and premium packages.
2.2. The Company provides services directly or through partners.
3. SERVICE INFORMATION3.1. Service information is provided based on data from suppliers.
3.2. The actual appearance of hotels, rooms, or transportation may differ from photographs due to seasonality, renovations, or hotel policies.
3.3. The Company has the right to substitute a listed service with one of equivalent quality and category if the original option is unavailable.
3.4. The Client must provide accurate information (names, dates, number of guests, etc.).
4. PRICING AND PAYMENT4.1. Service pricing is determined individually and may depend on seasonality, exchange rates, room availability, and supplier tariffs.
4.2. Payment is accepted through the following methods:
- Bank cards (KZT, USD, AED);
- Bank transfer;
- Online payment;
- Money transfers;
- Cash payment upon meeting;
- Partial or full prepayment.
4.3. Booking is confirmed only after payment is received.
4.4. If payment is delayed, the Company may cancel the service without notifying the Client.
5. SERVICE PROVISION CONDITIONS5.1. Check-in time, check-out time, deposit, breakfast, and accommodation rules are determined by the hotel.
5.2. The Company does not interfere with supplier regulations.
5.3. The Client undertakes to comply with rules of conduct, the legislation of the Republic of Kazakhstan, and the requirements of the guide and driver.
5.4. If property of the hotel, transportation, or guide is damaged or rules are violated, the fine is paid by the Client.
5.5. The Company has the right to refuse service in case of aggressive behavior or intoxication.
6. CANCELLATION, CHANGES, AND REFUNDS6.1. Cancellation conditions depend on the supplier's policy.
6.2. In most cases, non-refundable rates apply.
6.3. If the Client initiates cancellation, a fine set by the supplier is withheld.
6.4. In case of an authorized refund, funds are returned within 7–14 business days minus commissions.
6.5. The Company does not refund for:
- Late arrival for transfer;
- Non-appearance at an excursion;
- Self-initiated plan changes;
- Failure to provide required data.
6.6. Rescheduling or changes may result in price adjustments.
7. LIABILITY7.1. The Company's liability is limited to the amount paid by the Client for services.
7.2. The Company is not responsible for:
- Flight delays or cancellations;
- Baggage loss;
- Weather conditions;
- Government agency actions;
- Third-party actions;
- Client health;
- Client errors in providing data.
7.3. The Client is responsible for their documents, behavior, property, and compliance with rules.
8. CONFIDENTIALITY8.1. The Company maintains the confidentiality of the Client's data.
8.2. Data is transferred only to service providers, including but not limited to: hotels, guides, and transportation companies.
8.3. The Client agrees to the processing and transfer of their data.
9. DISPUTE RESOLUTION PROCEDURE9.1. Disputes are resolved through negotiation.
9.2. If negotiation fails, disputes will be resolved through the courts of the Republic of Kazakhstan at the location of the Company's registration.
10. FORCE MAJEURE10.1. Parties are released from liability in case of circumstances beyond their control, including but not limited to:
- Natural disasters;
- Military action;
- Government restrictions;
- Technical failures;
- Emergency situations;
- Border closures.
10.2. Services may be rescheduled or modified depending on supplier policies.
11. ADDITIONAL CONDITIONS11.1. The Company has the right to engage international partners, including but not limited to: travel agencies in the UAE and other countries.
11.2. Payment for services may be processed through payment agents and partners.
11.3. The Company has the right to amend this Offer without notifying the Client.
12. FINAL PROVISIONS12.1. The current version of the Offer is published on the Company's website.
12.2. Any interaction between the Client and the Company (even if the Client has not visited the website and has not read the Offer) constitutes acceptance of these terms.
